The Truth About Process Servers

By Elsa English

Human beings live in a world where everything is kept in order by a strict compliance of the rules set by the government. Most of these rules are general ones that people have to follow as a whole. There are also regulations that are unique to every state. Some rules can be applied to a particular group, some can be targeted to the unsuspecting public. There could be times that one may have brushes with the law, which could lead to Los Angeles process servers knocking at the front door.

A process server is a very important personnel in the field of laws and legalities. Without them, no trial is made because assailants or members of the defending party will never be aware of the fact that somebody has actually filed a case against them. This is why process servers are not really well known to the public, because only those who have faced lawsuits have come in contact with them.

He plays a very important role in the legal procedure also known as the service of process. This is the process wherein the offended party files a case against another and summons him or her to a hearing done in court. To be able to inform the offender about the said matter, legal documents are to be furnished and sent to him or her, including the details about the lawsuit. These are delivered by servers.

In the early years, these summons were originally served by the local sheriff. As the days went on, people found this to be impractical as the sheriffs get all tied up with running the jurisdiction that they cannot tend to their other duties any longer. This led to the need for that individual who can personally deliver the summons to the person specifically involved in a lawsuit.

Since then, it has been the duty of the server to deliver the said sets of documents that contained everything he needs to know about what he will be soon facing. He has to track down every single one of these people and hand over the process. Afterwards, he has to have the affidavit of service signed by the person who is being reported.

People often think servers have it easy because they only deliver papers. What they fail to note is that not all people who get snagged at lawsuits are really cooperative. Sometimes they like to give these delivery guys a very hard time, too.

This is why these one of a kind messengers have to possess an array of skills that will make them perform well at their job. First off, he has to be extremely patient. He must be prepared to wait on for hours for a person who will never come. He has to be prepared to come back the next day, too, in the hope that maybe he can chance upon the person he is looking for the moment he steps out to go to work.

He also has to have the instincts of a detective coupled with good research skills. It is not surprising for these delivery guys to come to an abandoned address because the person sued left in a hurry to escape the charges. As it is in the job description that you have to hand over the summons, a server also have to be a bit nosy and sniff out for clues.

You must also be prepared for a lot of emotions. These messengers are often ranted at and even attacked by the people they have come to visit. Indeed, being a process server is hard work.
